Terms of Service

Last updated: October 17th, 2026

These Terms of Service (“Terms”) govern your use of leadpilot360.ai, our demos and our services, provided by Lead Pilot 360, operating as Lead Pilot 360 (“Lead Pilot 360,” “we,” “us,” or “our”). By using our website or services, you agree to these Terms. If you are using them on behalf of a business, you confirm you have authority to accept these Terms for that business.

1. Our Services

Lead Pilot 360 provides websites, AI voice receptionists, AI chat assistants, CRM and workflow automations, review request tools, Google Business Profile setup and related digital marketing services (the “Services”). The specific services, pricing and features for each client are set out in the package or order you select (your “Order”). If a separate signed agreement exists between you and us, that agreement takes priority over these Terms where they conflict.

2. Website and Demos

You may use our website, demo phone line, chat assistant and custom demo tool for evaluating our Services. When you request a custom demo, you confirm that you own the website address you submit or are authorized to use it. You agree that we may read its publicly available content to create the demo. Demos are for illustration only, may contain errors, and are not a guarantee of how a finished system will perform.

You agree not to misuse our website or demos, including by attempting to gain unauthorized access, disrupting the service, submitting harmful content, or using automated tools to extract data.

3. Accounts and access

Each client receives its own account. You are responsible for keeping your login details secure, enabling multi-factor authentication where offered, and for all activity under your account. Tell us immediately if you suspect unauthorized access.

4. Fees and Payment

Fees are as stated in your Order. A one-time setup fee applies unless your Order says otherwise. Monthly fees are billed up to 7 days in advance and charged automatically to your payment method on file. A valid credit card must be stored on file for all active services.

The setup fee is non-refundable once setup work has begun.

Fees do not include usage-based charges above your plan’s included limits (such as additional call minutes, SMS messages or advertising spend), which are billed as described in your Order. Prices are in Canadian dollars and exclude applicable taxes (GST). If a payment fails, we may suspend the Services until the account is brought up to date. We may change our prices with at least 30 days’ notice.

5. Term and Cancellation

Services are month-to-month unless your Order states a different term. There is no long-term contract. You may cancel at any time by giving written notice to [email protected] at least 30 days before your next billing date. Cancellation takes effect at the end of the current billing period, and we do not offer prorated refunds.

We may suspend or end the Services if you breach these Terms, fail to pay, or use the Services unlawfully. When the Services end, your AI assistants, automations and phone forwarding will be switched off. On request, within 30 days of cancellation, we will provide an export of your contacts and conversation history where the platform allows. After that, we may delete your data.

6. Websites and Ownership

Purchased websites: If you pay the one-time website fee in your Order, you own the website’s content and design once paid in full. Hosting, the domain and third-party platform licences are separate and may carry ongoing costs. Due to proprietary restrictions, we do not provide transfer options. We will, however, provide an export of your existing data and images. We are not responsible for functionality iof the website data is exported and set up on a different platform.

Websites included in a monthly plan: If your website is included in a monthly plan, we retain ownership of the website, its design and its build. You receive a licence to use it while your plan is active. You may buy out the website on the terms set out in your Order.

In all cases, you keep ownership of your own content: your logo, business name, photos, text you supply, and your customer data. Our templates, workflows, prompts, automations and know-how remain our property.

7. Your Responsibilities

You are responsible for: providing us with accurate information about your business, services, hours, pricing and how calls should be handled, and telling us when it changes; reviewing your AI assistant’s setup before it goes live; complying with the laws that apply to how you contact and record your customers, including giving notice of AI use and call recording, and obtaining consent before sending commercial electronic messages under Canada’s Anti-Spam Legislation (CASL); making sure you have the right to any content, images or data you give us; and checking call summaries, messages and bookings regularly and following up with customers.

8. AI limitations and emergencies

Our AI assistants are designed to answer, qualify, book and route enquiries, but they can make mistakes. They may misunderstand a caller, give incomplete information or fail to complete a booking. You remain responsible for decisions made in your business and for confirming important details with your customers.

Our AI assistants are not an emergency service. They are not a substitute for 911 or emergency dispatch, and they must not be relied on to handle life-threatening situations. Where appropriate, your AI assistant can be set up to tell callers to hang up and dial 911.

9. Third-party services

The Services rely on third-party platforms, including CRM, telephony, SMS, AI and hosting providers, Google and Meta. We are not responsible for outages, changes or policy decisions by these providers, including phone carrier filtering of text messages, changes to Google or Meta platforms, or advertising account decisions. Where a third party changes or discontinues a feature, we will work with you on a reasonable alternative.

10. Results and Advertising

We work to improve your online presence, response times and lead handling, but we do not guarantee specific results, such as search rankings, number of calls, leads, bookings, reviews or revenue. Any figures on our website, including the missed revenue calculator, are illustrations only.

11. Acceptable Use

You may not use the Services to:

- send spam or contact people without the consent required by law;

- make misleading, deceptive or unlawful statements to customers;

- collect or store sensitive information unnecessarily, such as payment card numbers, through the AI assistant;

- impersonate any person or business; or

- violate the policies of our service providers.

12. Confidentiality and Privacy

Each of us will keep the other’s confidential information private and use it only for the purposes of these Terms. Our handling of personal information is described in our Privacy Policy. When we process your customers’ personal information, we do so on your behalf and only to provide the Services.

13. Disclaimer

Except as expressly stated in these Terms, the Services and website are provided “as is” and “as available.” To the extent permitted by law, we disclaim all other warranties, including warranties of merchantability, fitness for a particular purpose and uninterrupted or error-free operation.

14. Limitation of Liability

To the maximum extent permitted by law: we are not liable for any indirect, incidental, special or consequential damages, or for lost profits, revenue, jobs, customers or data; and our total liability for any claim relating to the Services is limited to the fees you paid us in the three (3) months before the claim arose. Nothing in these Terms limits liability that cannot be limited by law.

15. Indemnity

You agree to indemnify and hold us harmless from claims, losses and costs (including reasonable legal fees) arising from your content, your instructions to us, your breach of these Terms, or your violation of any law or the rights of a third party.

16. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and, for active clients, give at least 30 days’ notice of material changes by email. Continued use of the Services after changes take effect means you accept them.

17. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. You agree that the courts of Alberta have exclusive jurisdiction over any dispute.

18. General

If any part of these Terms is found unenforceable, the rest remains in effect. Failure to enforce a right is not a waiver of it. You may not assign these Terms without our written consent.
